Nano Global Corp. (“Nano,” “we,” “us” and/or “our”) is fully committed to user privacy and giving our users the most autonomy over their personal information possible. Nano is dedicated to protecting your personal information, informing you about how we use it, and giving you control over what happens to your personal data. This privacy policy (the “Privacy Policy” or the “Policy”) is intended to provide information to our visitors and users (“you,” “your”) about how we collect, secure, protect, share and use your information when you visit www.mynano.com (the “Website”) or use any of Nano’s apps, platform, or other online services (the “Services”). This Privacy Policy outlines how and when Nano collects, protects, shares, and uses information that can identify you individually (“Personal Information”), such as your name (including username), email address, telephone number, address, date of birth, and other demographic information as well as information related to your health and wellbeing. Personal Information does not include information that is anonymous, aggregated, or can no longer be used to identify you as an individual.

Please be sure to read this entire Privacy Policy before using or submitting information through the Website or the Services. If you do not agree with our Policy or privacy practices, your choice is not to use our Website. By using or submitting information through the Website or the Services, you are indicating that you agree to be bound by the terms of this Privacy Policy. This Privacy Policy is incorporated into Nano’s End User License Agreement (the “End User License Agreement”) available at www.mynano.com/pages/eula. Any capitalized term that is not defined in this Policy shall have the meaning given to it in the End User License Agreement.

This Privacy Policy covers the privacy practices of Nano only. This Policy does not apply to the practices of third-party websites, services or applications, including third-parties with which we partner. These third-party services are governed by each such third party’s privacy policy. Nano is not responsible for the privacy policies and practices of technology platforms other than that of Nano, and Nano is not responsible for the failure of unaffiliated third-parties to honor their privacy obligations. However, Nano is committed to partnering with third-party partners who value your data privacy as much as we do.

Please note that you retain all ownership rights over any health-related Personal Information that you upload to the Nano platform or direct Nano to retrieve from third-parties (“Health Data”). While your Health Data may be stored on Nano servers, we do not use or disclose your Health Data except as expressly stated in this Policy or with your express consent. In many cases Nano will just serve as a central interactive repository for your Personal Information generated by a third-party.

Information We Collect:

When you interact with us through the Website or the Services, we may collect Personal Information, including Health Data, and other information from you, as further described below.

Information You Provide:

We collect Personal Information, including Health Data, from you when you provide such information, such as when you create an account, provide registration or account information, or contact us with inquiries.

Information We Collect Automatically:

Website Usage Information. Nano may use a variety of technologies that passively or automatically collect information about how the Website and the Services are accessed and used, including your browser type, device type, operating system, application version, the pages served to you, the time you browse, preceding page views, and your use of particular features of the Services. This statistical data helps us understand what is interesting and relevant to users of the Services so that we can best tailor our content to you.

Device Identifiers. Nano also automatically collects an IP address or other unique identifier for the computer, mobile device, technology or other device (collectively “Device”) you use to access the Website and the Services. In the case of a mobile device, a “Device Identifier” is a unique id that is automatically assigned by the device manufacturer and is transmitted to our servers when you access them. An IP address is automatically assigned to your computer or your router by your internet service provider and is transmitted to our servers when you access them. We may use an IP address and/or Device Identifier to, among other things, administer the Website, help diagnose problems with our servers, analyze trends, track users’ web page movements, monitor against theft and fraud, and gather broad demographic information for aggregate use.

Session Tracking. In operating the Website and the Services, we may use cookies and similar session tracking technologies (“Session Trackers”). Session Trackers help provide additional functionality to the Website and the Services, customize users’ experiences and help us analyze Services usage more accurately for research and product development purposes. We (including third-parties that we work with) may also place Session Trackers on your Device for security purposes, to facilitate navigation of the Website and the Services, and to personalize your experience while using our Services. We use “local storage”, such as HTML5, to store content information and preferences. Third parties that provide certain features on the Website (e.g., YouTube) also use local shared objects (LSOs) such as flash cookies or local storage, and HTML5, to collect and store information. Various browsers may offer their own management tools for removing HTML5.

If you would prefer not to accept Session Trackers when using the Website or the Services, follow the instructions provided by your website or mobile browser (usually located within the “Help”, “Tools” or “Edit” facility) to modify your tracking settings. Please note that if you disable such tracking settings, you may not be able to access certain parts of our Services and other parts of our Services may not work properly. As a result, we recommend that you leave tracking settings turned on when accessing the Services because they allow you to take advantage of some of the features of the Services.

Web Beacons. In addition to Session Trackers, we may use “Web Beacons” (also known as “clear GIFs”), which are transparent graphic images placed on a web page or in an email and indicate that a page or email has been viewed or tell your browser to get content from another server. We use Web Beacons to measure traffic to or from, or use of, our online forms, tools or content items and related browsing behavior and to improve your experience when using the Services. We may also use customized links or other similar technologies to track hyperlinks that you click and associate that information with your Personal Information in order to provide you with more focused communications.

Non-Personal Information:

Additionally, we may modify and combine Personal Information and/or Health Data in a manner that does not personally identify you or any other individual and thus, no longer constitutes “Personal Information”. We may use this non-Personal Information, such as aggregate user statistics, demographic information, analytics, and usage information, for any lawful purpose.

Information from Third-parties:

We may receive information about you from third-parties. For example, we may receive information about you from outside records of third-parties, including Health Data, such as when you sync a third-party account or service with the Services. We may supplement the information we collect about you through the Services with such information from third-parties in order to enhance our ability to serve you or to tailor our content to you. If we combine such data with information we collect through the Services, such information is subject to this Privacy Policy unless we have disclosed otherwise. You may always elect to remove such information from your profile.

How We Use Information:

We may use the information we collect for a variety of reasons related to our operation and your use of the Website and the Services. We may combine information about you that we collect online, via mobile applications, and from third-party sources. Examples of specific ways in which Nano may use your Personal Information include, but are not limited to the following: 

  • Responding to your requests (including, for example, if you contact us to ask a question or report an issue with the Services, we may use the Personal Information you provide to answer your question or resolve your problem);
  • Improving the content, appearance and utility of the Website and the Services and determine effectiveness of Nano marketing and promotional campaigns;
  • Tracking our visitors’ use of the Website and the Services for internal research purposes, crime/fraud monitoring and prevention efforts, security and to enhance our product messaging to you;
  • Providing necessary notices to you and notifying you about updates to the Website or the Services;
  • Configuring your account settings;
  • Communicating with you about your account and/or use of the Services;
  • Sending you marketing or promotional material;
  • To allow you and other customers to submit a testimonial on our Website, and to display on our Website personal testimonials of satisfied customers and other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us per the “Contact Details” section below;
  • To allow you to access and post information to our blog. Our Website may offer a publicly accessible blog and community forum. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your Personal Information from our blog or community forum, contact us per the “Contact Details” section below; and/or
  • To perform accounting, auditing, billing, reconciliation, and collection activities, and to enforce the End User License Agreement.

Email Communications. We may use your Personal Information to provide you with marketing or other promotional communications via email. If, at any time, you would like to stop receiving these promotional emails, you may follow the opt-out instructions contained in any such email. Please note that by opting out, you may prohibit Nano from informing you of offerings that may be of interest to you. It may take up to ten (10) business days for us to process opt-out requests. If you opt-out of receiving emails or promotions from us, we still may send you emails about your account or any products or services you have requested or received from us, or for other customer service purposes.

Health Data. We only use your Health Data to service and maintain your account pursuant to your instructions. We do not use your Health Data for any other purpose without your express consent.

Disclosure of Personal Information:

Except as provided herein, Nano will not sell, rent or otherwise disclose Personal Information, including Health Data, about you to third-parties.

Third-party providers. We may share your Personal Information, including Health Data, with unaffiliated third-parties that provide certain services to us, including, but not limited to email management, customer care or performing analytics. These third-parties may have access to Personal Information or non-Personal Information in order to perform their functions on our behalf. However, these third-parties are only permitted to use your Personal Information, including Health Data, for the purpose for which it has been provided or to administer, service or process transactions that you have authorized, and may not disclose it to any other third-party except at our express direction and in accordance with this Policy.

Business transfers. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or our assets, or assets related to the Website or the Services, then the following may be disclosed to such entity as part of the business transfer: (a) Personal Information, (b) information about how the Website and the Services are accessed and used, and (c) any other information that we have collected about the users of the Website and the Services.  Also, if any bankruptcy or reorganization proceeding is brought by or against us, certain information may be considered an asset of ours and as such may be sold or transferred to third-parties. If a business transfer occurs, we will notify you before your Personal Information, including your Health Data, is transferred and becomes subject to a different privacy policy. At that time, you may choose to delete certain Personal Information associated with your account, including Health Data, or you may cancel your account. If you choose to continue using the Website or the Services, your Personal Information will remain subject to the promises and commitments contained in this Policy until such time as this Policy is updated or amended by the acquiring party upon notice to you.

Legal disclosures. Nano may transfer and disclose information, including, but not limited to: (a) your Personal Information and Health Data, (b) information about how the Website and the Services are accessed and used, and (c) information from our service providers, to third-parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our End User License Agreement or other applicable terms and conditions or policies; to respond to an emergency; or otherwise to protect the rights, property, safety or security of third-parties, users of our Website or the Services, or the public.

With your permission. At your direction or request, we may share your Personal Information, including Health Data, with specified third-parties.

Syncing, Linking, Connecting Your Third-party accounts with the Services, Importing Data:

You may choose to sync your Nano account with information, including Health Data, from other accounts held by third-parties, such as healthcare providers. To sync your third-party account information, we must access your online account with those third-party providers. We will request your username, password, and any other login data that you have set up with your third-party provider to enable access. By syncing your Nano account, you authorize us to access your third-party account information maintained by identified third-parties, on your behalf as your agent, and you expressly authorize such third-parties to disclose your information to us. Please note that Nano may log in to your third-party accounts from time to time to sync your Nano account with information from your third-party accounts. More specifically, Nano will only log in to your third-party accounts to establish, maintain, or debug a secure connection between your Nano account and your third-party accounts or to verify the accuracy of a sync; as noted above, we will not share or disclose your Health Data or any other information associated with your third-party accounts to any other party unless you expressly direct us to do so.

If you believe that a third-party has provided us with your Personal Information and you no longer wish us to possess your information, you may request deletion of your information by emailing us at privacy@mynano.com.

Updating Your Personal Information and Information Retention:

If you wish to modify, verify, correct, delete, or update any of your Personal Information collected through the Website, you may edit your profile.

In accordance with our routine record keeping, we may delete certain records that contain Personal Information, including Health Data, you have submitted through the Website or the Services. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data remaining because of backups and other reasons.

We will retain your Personal Information, including Health Data, as long as you maintain an account, or as needed to provide you services, comply with our legal obligations, resolve disputes, or enforce our rights and agreements. You can deactivate your account by contacting us at hello@mynano.com. When you do, data that can identify you will be removed from the Website and the Services. Backup copies of this data will be removed from our server based upon an automated schedule, which means it may persist in our archive for a short period. Nano may continue to use your de-identified data after you deactivate your account.

Security of your Personal Information:

Nano maintains reasonable safeguards to prevent unauthorized intrusion to its Website and Services and the alteration, acquisition or misuse of Personal Information, including Health Data, by unauthorized persons. Nano restricts authorized access to your Personal Information, including Health Data, to those persons who have a legitimate purpose to know that information to provide products or services to you and those persons you have authorized to have access to such information. However, we cannot guarantee that your communication with us will be completely secure or free from unauthorized access by third-parties. You use the Website and provide us with your Personal Information at your own risk.

You need to prevent unauthorized access to your account and Personal Information, including Health Data, by implementing and protecting your Device password appropriately and limiting access to your Device. We also recommend that you change your Device password periodically. You are responsible for maintaining the security of your account username and password. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), you must immediately notify us of the problem by contacting us and change your password immediately via the Website.

Children Under 13:

The Website is not directed to or intended for use by children under 13 years of age and we do not knowingly collect Personal Information, including Health Data, directly from children under 13. If we become aware that a child under 13 has provided us with Personal Information, including Health Data, we will make reasonable efforts to delete such information from our files. However, some Services may allow a parent or guardian to provide Personal Information related to a child under 13 for whom that parent or guardian has legal guardianship as defined by applicable law.

Your California Privacy Rights:

We do not share your Personal Information, including Health Data, with third-parties for their marketing purposes without your consent. Nano does not track you across third-party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. Nano also does not knowingly authorize third-parties to conduct online tracking on Nano’s Website or the Services.

Changes to this Policy:

This Policy is the sole authorized statement of Nano’s practices with respect to the collection of Personal Information, including Health Data, and the subsequent use and disclosure of such information. Any summaries of this Policy generated by third-party software or otherwise (a) shall have no legal effect, (b) are in no way binding upon Nano, (c) shall not be relied upon in substitute for this Policy, and (d) neither supersede nor modify this Policy.

Nano may revise this Policy from time to time without prior notice to you, and any changes will be effective immediately upon the posting of the revised Policy. We encourage you to periodically review this Policy to stay informed about how we collect, use and share Personal Information. You can determine when this Policy was last revised by checking the “Last Updated” legend at the top of the Policy.
